1. Scope

These Terms of Service (“Terms”) apply to your use of the eveinsights platform (“Service”, “we”) at eveinsights.ai and related services. “You” or “User” means any natural or legal person using the Service. By registering or using the Service, you accept these Terms.

2. Description of the Service

eveinsights provides a software-as-a-service platform for creating and using AI agents for customer feedback, support, and review optimization. Specific features (e.g. agents, chat, insight extraction, widget embedding) are described on the website and in the dashboard. We may evolve the Service for legitimate reasons, provided core agreed functionality is maintained.

3. Registration, Account, and User Obligations

Registration is required to use the Service. You provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You use the Service only in compliance with applicable law and do not distribute unlawful, offensive, or misleading content via the agents or widget you configure.

4. AI, Content, and Intellectual Property

AI outputs (e.g. replies, extracted data) are generated from your configuration and customer data. You are responsible for the content of the texts used by your agents (prompts, rules) and for how the Service is integrated (e.g. widget). Unless we grant you additional rights, all rights in our platform, technology, and marks remain with us. We grant you the rights necessary for the agreed use of the Service.

5. Privacy

Processing of personal data in connection with the Service is described in our Privacy Policy. You act as data controller for data you process via the Service (e.g. customer data in chat). You will enter into any agreements we require for use of the Service (e.g. data processing agreement) if we provide such documents.

6. Limitation of Liability

We are fully liable for intent and gross negligence, and for harm to life, body, or health. For simple negligence we are liable only in case of breach of essential contractual obligations and only up to the foreseeable, typically occurring damage. Liability under applicable product liability law remains unaffected. Otherwise liability is excluded to the extent permitted by law.

7. Term, Termination, Suspension

Use may be indefinite or for a fixed term depending on the plan. You may cancel your account at any time in account settings or ask us to delete it. We may suspend access or terminate the account in case of serious breach of these Terms or applicable law. Prepaid amounts will not be refunded in such cases unless we agree otherwise.

8. General

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For disputes with merchants, our place of business is the place of jurisdiction unless mandatory law provides otherwise. We will notify you of changes to these Terms by email or in the dashboard; you may object or terminate within the period stated. If any clause is invalid, the rest remains in effect.
